Feminist Legal Analysis

Pregnancy Discrimination


The issue of pregnancy discrimination is alive and well in our workforce,
with some employers either refusing to hire women of child-bearing age, or
terminating those who are about to go on maternity leave.  The topic of
pregnancy discrimination encompasses a lot of areas, so at this program, we
will focus on the issues of termination, reinstatement and the available
remedies. The discussion will focus around the practical issues in choosing
which forum under which to proceed and the remedies available in each
(wrongful dismissal, employment standards complaint or human rights
complaint - or all of them).  The impact of EI benefits and bad faith in a
wrongful dismissal will be discussed, as well as a review of the recent case
law.  Our speakers will also review employees' entitlements (and employer's
obligations) upon reinstatement.



Melanie Manning
Ms. Manning is the author of Pregnancy, the Workplace and the Law and is
legal counsel with the Employment Law Group at Scotiabank.


Jennifer Fantini
Ms. Fantini is an associate in the Labour and Employment Law group with
Borden Ladner Gervais in Toronto.
